1. Introduction
These Driver Terms and Conditions ("Terms") govern your use of the driver platform operated by Toot Group OÜ ("we", "our", "us").By registering as a driver or using the Service, you agree to be bound by these Terms.
2. Role of the Platform
The Service is a technology platform that connects drivers with riders. We do not provide transportation services and are not a transport operator. You provide transportation services independently and at your own responsibility.
3. Eligibility and Account
To use the Service as a driver, you must:
Be at least 18 years old
Hold a valid driver’s license
Provide accurate and complete information
Pass required verification checks
If you act on behalf of a company, you confirm that you have authority to bind that entity. You are responsible for your account and all activity under it.
4. Driver Obligations
You agree to:
Comply with all applicable laws and regulations
Hold all necessary licenses, permits, and insurance
Ensure your vehicle is safe and roadworthy
Provide services in a professional and lawful manner
5. Payments and Payouts
Rider payments are collected by Toot Group OÜ.
Driver earnings are calculated based on completed rides, minus applicable service fees.
Payouts:
Are made periodically (e.g. weekly)
Are transferred to your registered business or entrepreneur bank account
Will not be made to personal accounts where business registration is required
You are responsible for ensuring your payout details are accurate.
6. Fees and Commission
We charge a platform/service fee for use of the Service.
The fee is deducted from rider payments before payouts are made to you.
Fee structure may be updated from time to time and will be communicated via the app.
7. Taxes and Legal Responsibility
You are solely responsible for:
Declaring and paying all applicable taxes
Complying with local tax and business regulations
We do not act as your employer, agent, or tax advisor.
In accordance with EU DAC7 regulations, we may be required to:
Collect tax-related information
Report your earnings and identification data to tax authorities
8. Cancellation and No-Show
You are expected to accept and complete ride requests responsibly.
Repeated cancellations, no-shows, or failure to provide services may result in:
Reduced visibility in the platform
Temporary suspension
Permanent deactivation
9. Ratings and Performance
Riders may rate your performance.
We may monitor:
Ratings
Acceptance rates
Cancellation rates
Failure to meet required standards may result in account restrictions or termination.
10. Prohibited Conduct
You must not:
Engage in unsafe or illegal behavior
Discriminate against riders
Use the platform for unauthorized purposes
Manipulate pricing or trips
11. Suspension and Termination
We may suspend or terminate your account at any time if you:
Violate these Terms
Fail to meet platform standards
Engage in fraudulent or unsafe behavior
12. Limitation of Liability
To the maximum extent permitted by law:
We are not responsible for your actions or services
You are solely responsible for transportation services provided
We are not liable for indirect or consequential damages
13. Indemnification
You agree to indemnify and hold harmless Toot Group OÜ from any claims, damages, or liabilities arising from:
Your use of the Service
Your transportation services
Violations of laws or these Terms
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Estonia.
Any disputes shall be resolved in the courts of Estonia.
15. Changes to the Terms
We may update these Terms from time to time.
Continued use of the Service constitutes acceptance of updated Terms.
